Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are a minor, you represent that you have parental or guardian consent. If you use the Service on behalf of a company, you represent that you have authority to bind that entity.

2. Account and Security

You agree to provide accurate information and keep your account details updated. You are responsible for safeguarding your login credentials and for all activity under your account.

You must notify us immediately if you suspect unauthorized use of your account.

3. Description of the Service

Treiner facilitates communication and training plan management between trainers and clients. Treiner is not a medical provider and does not provide medical advice, diagnosis, or treatment.

4. Conditions of Use

You agree not to:

• Violate any applicable laws or regulations.
• Upload unlawful, fraudulent, defamatory, or harmful content.
• Impersonate another person or misrepresent your identity.
• Attempt unauthorized access to accounts or systems.
• Interfere with the Service’s security or operation.
• Distribute malware or harmful code.
• Use the Service for spam or unsolicited communications.

We may suspend or terminate your account if you violate these Terms.

You must use the Service only for lawful personal or professional purposes and in accordance with the intended functionality offered by TreinerApp.

5. Trainers and Clients

Trainers are solely responsible for the content, routines, and recommendations they provide. Clients are responsible for consulting a healthcare professional when appropriate and exercising personal judgment before following any training plan.

6. Subscription Rules

The Service may offer paid subscriptions or premium features. Pricing and terms are displayed at checkout.

By purchasing a subscription, you authorize us or the relevant app store to charge the applicable price, taxes, and fees for the selected plan. Duration, benefits, renewals, and usage limits depend on the active plan presented at the time of purchase.

Apple App Store: Purchases made through Apple are governed by Apple's payment policies and managed through your Apple ID.

Google Play: Purchases made through Google are governed by Google’s payment policies and managed through your Google account.

Subscriptions may renew automatically unless canceled. Except as required by law, payments are non-refundable.

7. Cancellation

You may cancel automatic renewal of your subscription at any time through the applicable purchase platform, including Apple App Store or Google Play, or through any cancellation mechanism made available within the Service.

Cancellation prevents future renewal charges, but does not retroactively void charges already processed and does not guarantee refunds unless required by applicable law or the relevant store policy.

8. User Content

You retain ownership of the content you upload. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely to provide and improve the Service.

You represent that you have the necessary rights to share such content.

9. Privacy

Our data practices are described in our Privacy Policy .

10. Software License

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the software of TreinerApp solely for the intended purpose of the Service.

The Service and its content, including software, branding, and design, are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, decompile, reverse engineer, or exploit any part of the Service without prior written authorization.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

12. Health Disclaimer

Physical exercise involves inherent risks. You should consult a qualified healthcare professional before beginning any training program.

Treiner is not responsible for any injury, health condition, or damage resulting from workouts, routines, or recommendations provided by trainers. Participation in any physical activity is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Treiner shall not be liable for indirect, incidental, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

Our total liability shall not exceed the amount paid by you in the three (3) months prior to the claim, or USD $100 if no payments were made.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or for legal, technical, or security reasons.

15. Governing Law

These Terms are governed by the laws of the Republic of Colombia. Any disputes shall be resolved in the competent courts of Cali, Colombia, unless otherwise required by mandatory consumer protection laws.
